The case is Johnson v. US.  Scalia writes that a prior conviction for battery by offensive touching is NOT a crime of violence because it does not require the use of violent force. What a concept: a crime of violence requires violence.

This is not a valid enhancement, for two reasons. First, the enhancement applies to an "obliterated" serial number, not an absent one. Second, many older firearms never had a serial number in the first place.
